2010 Winter E-News: Southampton Town Approves Dark Skies Legislation

After a long battle, we are happy to announce the Town of Southampton approved a dark skies law on December 8, 2009. The intent of the law is to limit excessive lighting, reduce skyglow, mitigate road glare, prevent light trespass, conserve energy and protect a shared resource – our view of the nighttime sky.

Prior to the passage of this legislation, the highly politicized and hotly debated issue of whether to address existing homes and businesses saturated the dialogue. There were nine public hearings held between June and November!

Despite widespread community support, including 500 supportive petition signatures, over 60 letters of support, letters to the editor and multiple presentations from the Group and well-renowned dark skies advocates, the Town Board avoided addressing light pollution from existing homes and businesses.

The Group advocated for a phased-in compliance period that would allow residents and business owners to address existing, excessive lighting issues over time – not only potential sources from new installations. We were disappointed that these provisions were not included because existing light pollution has detrimental effects on nocturnal wildlife and migrating birds. How can we solve the problem if we fail to address current violations?

Although the law does not require phased-in compliance, it does allow neighboring property owners to file a complaint with the Town if they believe lighting causes a hazard, glare or trespass. If a nuisance exists, the source must come into compliance with standards now required for new construction or installation. Additionally, the legislation requires that any lighting fixture (residential or commercial) that is replaced, changed, repaired or relocated must comply with the new regulations. Despite its shortcomings, Southampton’s dark skies law will assure that all new construction is “dark sky compliant" and it represents forward progress on the issue of energy conservation and the protection of our view of the nighttime sky. A big thanks to all Group members who participated in our Action Alert campaigns, wrote personal letters and attended public hearings – your voice and input truly make a difference.
